Welcome to Deskpop Hosting! These Terms of Service (“Terms”) govern your use of our website, web hosting, and design services (collectively, the “Services”). By using our Services, you agree to these Terms. If you do not agree, do not use our Services.
1. Services
1.1 Web Hosting & Design
Deskpop Hosting provides web hosting and design services tailored to the firearm industry and other businesses. Our hosting plans, security measures, and customer support are designed to ensure your website remains operational and secure.
1.2 Account Registration
To use our Services, you may be required to create an account. You must provide accurate and complete information and keep it updated. You are responsible for all activities under your account.
1.3 Service Modifications
We reserve the right to modify, suspend, or discontinue any part of our Services at any time, with or without notice. In the event of a customer violation of Terms of Service, we reserve the right to immediately shut down and discontinue sharing your site and assets to the web immediately.
2. User Responsibilities
2.1 Acceptable Use
You agree not to use our Services for any illegal, abusive, or harmful activities, including but not limited to:
- Hosting or distributing malware, phishing sites, or spam.
- Violating intellectual property rights.
- Any activity that violates applicable laws and regulations.
2.2 Content Ownership & Liability
- In the case where the site is built and maintained by you or a 3rd party not affiliated with Deskpop Hosting, you retain ownership of your website content but grant us a license to host, store, and display it.
- In the case where your site has been built by Deskpop Hosting or an affiliate, ownership comes under your control upon full payment of all design services. Until that time, the entire site and all content is the property of Deskpop Hosting.
- If you, the customer, chooses NOT to have maintenance covered by Deskpop Hosting, then you are solely responsible for all content and activities on your website.
- If you, the customer, agrees to and pays in full and on time for maintenance services, then Deskpop will post the content and maintain your site as long as payment is up to date and communications are held. You are still responsible for any and all content posted to your site. As such, we will submit content to you for approval before posting. We reserve the right to post the content to a staging site or to the public site. It is your responsibility to ensure that what we post on behalf of you is true and accurate prior to agreeing for our posting of content, and after we post the content to your page.
2.3 Security & Backups
We implement security measures, but you are responsible for keeping your credentials secure. We recommend regular backups, as we are not liable for data loss.
- You are required to maintain the security that we setup on your site and not remove it. This includes, but is not limited to, the following
- Wordfence Security plugin (or some other Security software approved by Deskpop Hosting)
- This will be installed and maintained on your site, either by you or by us. It is your responsibility, if we are not involved in setup and maintenance, to keep Wordfence installed, active, and up to date.
- 2FA/MFA
- Also known as Two Factor Authentication, this must be setup and maintained on your site at all times.
- Cloudflare
- Your domain MUST be connected to a domain that allows Cloudflare to work as a security layer between our site and the server. To date, we know that Wix is incompatible with this feature, and you must move the domain from Wix to a compatible domain service, or find another hosting platform.
- Updates and maintenance
- To the best of our ability, updates are automated on our end. However, if you choose plugins or themes that are not compatible with our updating software, you MUST keep these up to date on your own.
- Country level filtering
- Unless your site requires access from outside of the U.S., we will filter your site so that it is viewable only from the United States. This will help stop your site from attacks from bots and bad foreign actors.
- Wordfence Security plugin (or some other Security software approved by Deskpop Hosting)
Any violation of these security protocols may cause your site to be shut down or removed from our service. We are glad to walk you through the setup and use these security protocols.
3. Payment & Billing
3.1 Fees & Payment Terms
- Payment is required in advance for all hosting and design services.
- Late payments will result in service suspension or termination.
- All fees are non-refundable unless otherwise stated in our refund policy.
3.2 Cancellations & Termination
- You may cancel your service at any time; however, no refunds will be issued for unused time.
- We reserve the right to terminate accounts for violations of these Terms.
4. Limitation of Liability
To the fullest extent permitted by law, Deskpop Hosting is not liable for any indirect, incidental, or consequential damages, including but not limited to lost revenue, data loss, or service interruptions.
This includes loss of connectivity to your site.
5. Indemnification
You agree to indemnify and hold Deskpop Hosting harmless from any claims, damages, or expenses resulting from your use of the Services or violation of these Terms.
6. Governing Law & Dispute Resolution
These Terms are governed by the laws of [Insert State/Country]. Any disputes shall be resolved through binding arbitration in [Insert Location].
7. Changes to These Terms
We may update these Terms from time to time. Continued use of the Services after updates constitutes acceptance of the revised Terms.
